Outside Athletic Related Income

The National Collegiate Athletic Association (NCAA) and Texas Tech University (TTU) both have specific guidelines to provide full disclosure of potential earnings from outside sources. Therefore, Texas Tech University has developed policies and procedures to track outside income. The Compliance Office will be responsible for monitoring and ensuring that the department is in compliance with NCAA and institutional rules. This document outlines the requirements and procedures that should be followed to ensure this compliance.

NCAA Requirements:
The NCAA requires all full-time or part-time athletics department staff members (excluding secretarial or clerical personnel) to provide a written detailed account annually to the chief executive officer for all athletically related income and benefits from sources outside the institution. The NCAA rules that require this approval are as follows:

  • NCAA Bylaw 11.2.2 Athletically Related Income. Contractual agreements, including letters of appointment between a full-time or part-time athletics department staff member (excluding secretarial or clerical personnel) and an institution shall include the stipulation that the staff member is required to provide a written detailed account to the chief executive officer for all athletically related income and benefits from sources outside the institution. In addition, the approval of all athletically related income and benefits shall be consistent with the institution's policy related to outside income and benefits applicable to all full-time or part-time employees. Sources of such income shall include, but are not limited to, the following: (a) Income from annuities; (b) Sports camps; (c) Housing benefits (including preferential housing arrangements); (d) Country club memberships; (e) Complimentary ticket sales; (f) Television and radio programs; and (g) Endorsement or consultation contracts with athletics shoe, apparel or equipment manufacturers.

  • NCAA Bylaw 11.3.2.1 Bona Fide Outside Employment. A staff member may earn income in addition to the institutional salary by performing services for outside groups.

  • NCAA Bylaw 11.3.2.2 Supplemental Pay. An outside source is prohibited from paying or regularly supplementing an athletics department staff member's annual salary and from arranging to supplement that salary for an unspecified achievement. This includes the donation of cash from outside sources to the institution earmarked for the staff member's salary or supplemental income. It would be permissible for an outside source to donate funds to the institution to be used as determined by the institution, and it would be permissible for the institution, at its sole discretion, to use such funds to pay or supplement a staff member's salary.

    TTU Requirements:
    TTU requires that all exempt (salaried) employees shall report outside income.

    Under both NCAA and TTU policy, select employees are required to provide a written detailed account annually to the chief executive officer for all athletically related income and benefits from sources outside the institution. The Athletic Compliance Office will facilitate obtaining the necessary approvals and confidential disbursement of information. A timeline and outline of these procedures are as follows:

    September 1The "Outside Income" form is sent with an explanatory memo to all full-time and part-time staff (excluding secretarial or clerical personnel) for completion and return by September 15th.
    September 15The Compliance Office prepares a spreadsheet containing the reported outside income of all athletic department employees. This spreadsheet contains approval signature lines for the Director of Athletics and the President.
    September 20The Compliance Office submits the "Outside Income" spreadsheet to the Director of Athletics for approval and return.
    September 25The Compliance Office submits the "Outside Income" spreadsheet to the President for approval and return.

    NOTE: The initial process above will also be conducted immediately upon hire of new employees to the athletic department.

    This form is for full-time or part-time Intercollegiate Athletic Department employees (excluding secretarial or clerical personnel) to provide a written detailed account annually for outside income. It is each employee's responsibility to provide this information to the Compliance Office for confidential processing by the Director of Athletics and the President.
